Frank Aigotti Jr. and Jacinda Moore, both of Wantage, were accused of robbing Lakeland Bank in Wantage in January 2015.

NEWTON -- The couple accused of robbing the Lakeland Bank on Route 23 in Wantage last year have had most of the charges against them dismissed due to improper wording in the indictment against them, New Jersey Herald reported.

6432304_G.jpgState Police released a surveillance camera image of a man they say robbed a Wantage Lakeland Bank in January of 2013. Authorities later said they identified the alleged robber as Frank Aigotti.

Frank Aigotti Jr. and Jacinda Moore, both of Wantage, were arrested in January 2015 following a 16-day joint investigation by New Jersey State Police, the FBI and detectives from the Sussex County Prosecutor's Office.

Sussex County First Assistant Prosecutor Greg Mueller said at the time the couple's arrest was based on the review of video surveillance, witness interviews and an analysis of forensic and physical evidence obtained by investigators.

Both Aigotti and Moore were charged with robbery, conspiracy to commit robbery, theft of moveable property and fraudulent credit card use.

According to New Jersey Herald, Judge William J. McGovern dismissed the first-degree robbery charge due to improper wording, along with several other counts as they were dependent upon the robbery charge.

However, McGovern, the newspaper reported, upheld charges of theft and fraudulent use of a credit card against both along with drug charges and another theft charge against Moore.

The prosecutor's office has filed a motion for the judge to reconsider his decision, according to the report.
