Ex-cop facing Burger King bathroom sex assault charge wants out of jail

Former Newton Police Officer Jason Miller remains jailed in Morris County and is seeking a reduction in his $200,000 bail.

HAMPTON -- A former Newton police officer charged with sexually assaulting a 16-year-old boy in a Burger King bathroom last month is making a second try at getting out of jail.

Jason R. Miller, 39, of Hampton, is appealing a judge's refusal to lower his $200,000 bail. A hearing in Superior Court in Newton is scheduled to begin at 1:30 p.m. Wednesday.

Miller has pleaded not guilty to all charges in the alleged assault on Dec. 15. His attorney, Anthony Iacullo, previously said that his client "vigorously denies" the charges.

Miller remained in the Morris County jail as of Tuesday.

The ex-cop appeared in court via video hookup Dec. 21 when Judge David Weaver denied his initial request for a lower bail.

Judge William McGovern, who set Miller's bail, is presiding at his appeal of that decision.

McGovern raised his bail from $75,000 to $200,000 after prosecutors added second-degree sexual assault, criminal restraint and criminal sexual contact to their original filing, two counts of endangering the welfare of a child.

Miller was on probation at the time of his arrest.

He resigned from the Newton force in 2015 as part of a plea agreement after allegations he exposed himself to male motorists during traffic stops.

As part of Miller's guilty plea to tampering with records, charges of lewdness and official misconduct were dismissed.

He avoided a jail sentence but was sentenced to two year's probation.
