Man shot by State Police after domestic violence report released from hospital

Matthew Gerndt was shot on Sunday night by troopers attempting to arrest him for assaulting his girlfriend, authorities said.

JEFFERSON -- The 35-year-old township man who was shot by a State Police trooper on Sunday night was released from the hospital on Monday afternoon, authorities said.

Matthew Gerndt was released into the custody of State Police troopers with Netcong station and later taken to the Morris County Correctional Facility, said Peter Aseltine, a spokesman for the Office of the Attorney General.

Gerndt is being held in jail on a domestic violence assault charge pending a detention hearing on Friday, Aseltine said.

Authorities say Gerndt assaulted his girlfriend while driving on Route 80 and kicked her out of the car while on the highway. The woman was later found by State Police walking along the shoulder of Route 80 with injuries to her face and body.

State Police troopers went to the Brady Road home Gerndt rents at about 11:30 p.m. Sunday to arrest him for the alleged assault, but, after they identified themselves, Gerndt went into the house and locked the patio doors behind him, the Attorney General's Office said.

Troopers then entered the residence and tried to arrest Gerndt in a hallway when he "charged aggressively" at a trooper who fired twice, striking Gerndt once in the lower body, authorities said.

Aseltine said troopers had consent to enter the residence, but he didn't indicate whose consent the troopers had.

No troopers were injured in the incident, but Gerndt was taken to Morristown Medical Center for treatment. 

He's currently facing charges of assault and resisting arrest.
