Ex-cop accused of Burger King bathroom sex assault offered plea deal

Jason R. Miller has not accepted the offer, his attorney said

NEWTON -- The former Newton police officer accused of sexually assaulting a 16-year-old boy in a Burger King bathroom has been offered a plea deal that calls for a five-year prison term.

Jason R. Miller, 40, of Hampton, has pleaded not guilty to the charges. His attorney Anthony Iacullo, said Wednesday that Miller was not inclined to take the deal.

"The offer as it stands is not acceptable to Jason," Iacullo said.

The plea offer was disclosed by Sussex County Assistant Prosecutor Laura Nazzaro during a Superior Court hearing Tuesday. In addition to five years in prison, Miller would be required to register as a sex offender if he agreed to plead guilty to a child endangerment charge.

Miller, 40, of Hampton, was indicted in April on five charges, including second-degree sexual assault, for which the maximum penalty is 10 years in prison.

Miller resigned from the Newton force in 2015 as part of a plea agreement amid allegations he exposed himself to male motorists during traffic stops.

In that case, Miller avoided jail time after pleading guilty to tampering with records, a fourth-degree crime, in exchange for prosecutors dropping charges of official misconduct and lewdness.

Miller was on probation when he was arrested in December. He spent about four months in jail before being released on bail. He is scheduled to return to court Oct. 25. 

Miller is seeking recorded statements made to police from the alleged victim and two others at the Burger King as he prepares for trial, his attorney said.
