The Daily Record reports that Francis Wagner claims the insults have caused him emotional distress and exacerbated his poor health
MORRISTOWN - A man has filed a lawsuit seeking damages for physical and emotional distress caused by insults written on the weekly spousal support checks he receives from his ex-wife.
According to the Daily Record, 61-year-old Francis Wagner filed the complaint in Morris County Superior Court Thursday, claiming the $186 checks regularly come with missives calling him a "bum", "loser" and other pejorative terms.
A check posted to Facebook by Denville-based law firm Trautmann & Trautmann in March appear to be addressed to Wagner from his ex-spouse Diane Wagner, with the memo line noting that the payment is for "Alimony/Adult Child Support".

In divorce filings, the former Mrs. Wagner, of Hopatcong, claims she ended the marriage after 10 years after growing tired of "drunken bouts" with her husband. She has also claimed that she has been diagnosed with terminal cancer, according to the newspaper.
Francis Wagner also contends that the written insults have exacerbated his own health issues, including cancer and unspecified heart problems.
