Couple charged with hosting underage drinking party to sue cops for Facebook post

The Gitelman's were charged with hosting an underage drinking party in April.

SPARTA -- A woman who was charged in April with hosting an underage drinking party plans to sue Sparta police after they posted details of the incident on Facebook, according to a published report.

The notice of intention to sue warns of an impending lawsuit that seeks $500,000 for Karen Gitelman and her husband, Daniel, the New Jersey Herald reported.

The Gitelmans were charged in April with hosting an underage drinking party at their Westgate Drive home in Sparta. They were also charged with endangering the welfare of a child and obstructing the administration of law after they allegedly lied to police about the whereabouts of a 15-year-old boy who was drunk.

Police said when officers arrived to treat the boy, Daniel Gitelman told police the boy had been picked up by his parents, when he was actually lying face down, unconscious, on the back porch.

Details of the incident and the arrests were posted by Sparta police on their Facebook page on May 6.

The tort notice claims the Gitelman's were libeled and slandered as a result of the post, and have suffered mental pain and suffering, according to the New Jersey Herald.

Sussex County First Assistant Prosecutor Gregory Mueller declined to comment on the tort claim notice, but said officials are required by state law to inform residents of basic information within 48 hours of an arrest.
